Participation in a trial by remote means

A remote connection may be used in a trial, for example

  • in domestic trials, for example, between different places of business and authorities;
  • in situations where the parties to the proceedings do not need to be present in person be-fore the court hearing the case;
  • in cross-border proceedings, taking into account the provisions of international treaties.

In addition to the court, a proposal to use a remote connection in court proceedings may be made by a party to the case or by his or her attorney, a witness or a person to be heard. The possibility of remote access in court proceedings may be enquired at the court in question.

Hearing a person to be heard in another locality from their domicile or, for example, from abroad may be an appropriate option for all parties concerned. The use of remote access improves the posi-tion of the parties when they do not necessarily need to travel to the court.
